Checks on “employment of freelancers” in IT firms? And can they defend it? This was also what yesterday’s conference was about… When I was constructing the programme, I wanted to grasp this topic in a comprehensive way and also to point out: ➡️ A quick macro view (“View 1”);
➡️ a quick philosophical and moral view (“View 2”);
➡️ numbers – i.e. net vs. cost, how much who saves (“View 3”);
➡️ impacts on pensions, maternity, … (‘View 4’). This is not only to enrich the viewer with the individual content of each View 1-4, but also because without View 1-4, in my view, there is no way to have the full potential to find answers to the questions of whether the activities of sole traders, ‘one-person SROs’, authors, … is in IT, marketing, construction, … firms is defensible or under what conditions. Thus we had a talk by Martin Vlachynsky on macros and morality (View 1-2) and then my talk on morality, numbers and impact (View 2-4). So that in my next lecture we could then dive into the search for the boundary of when “sole trader/SRO” yes and when no in context (i.e. comprehensively). In that search, brainstorming with Katarina Matulnikova, the consummate employment law expert, was very helpful. And I also thank her for the subsequent informative discussion directly at the conference. And thanks as well to Tomas Strémy, who provided a valuable criminal law dimension to the whole (albeit sometimes frightening) issue. It was great to have him there in the discussion, because the mosaic would not be complete without that part. The youngest criminal law professor, by the way.
