
Even if only one spouse owns the business, the proceeds may belong to both.

➡️ Even if the share in the company belongs “on paper” to only one spouse, the proceeds from its business or sale are in most cases part of the community property of the spouses (BSM).
This means that after the divorce, the other spouse may be entitled to:
👉 part of the value of the business share when it is sold,
👉 part of the dividends paid from the company to the other spouse,
👉 payment of part of the value of the business share when the BSM is settled.
