European Banking Authority (EBA) has issued an ๐—ข๐—ฝ๐—ถ๐—ป๐—ถ๐—ผ๐—ป addressing the overlap between the MiCA and the PSD2.

โš–๏ธ ๐—ž๐—ฒ๐˜† ๐—ถ๐—บ๐—ฝ๐—น๐—ถ๐—ฐ๐—ฎ๐˜๐—ถ๐—ผ๐—ป๐˜€ ๐—ณ๐—ผ๐—ฟ ๐—–๐—”๐—ฆ๐—ฃ๐˜€ ๐—ฎ๐—ฟ๐—ฒ:

1. CASPs that transfer EMTs on behalf of clients, or provide custody and administration of EMTs, may fall under PSD2 as they are deemed to be executing payment transactions involving โ€œfundsโ€.

2. The EBA recommends a ๐˜๐—ฟ๐—ฎ๐—ป๐˜€๐—ถ๐˜๐—ถ๐—ผ๐—ป ๐—ฝ๐—ฒ๐—ฟ๐—ถ๐—ผ๐—ฑ ๐˜‚๐—ป๐˜๐—ถ๐—น ๐Ÿฎ ๐— ๐—ฎ๐—ฟ๐—ฐ๐—ต ๐Ÿฎ๐Ÿฌ๐Ÿฎ๐Ÿฒ, during which National Competent Authorities should ๐—ป๐—ผ๐˜ ๐—ฒ๐—ป๐—ณ๐—ผ๐—ฟ๐—ฐ๐—ฒ ๐—ฃ๐—ฆ๐——๐Ÿฎ ๐—น๐—ถ๐—ฐ๐—ฒ๐—ป๐˜€๐—ถ๐—ป๐—ด ๐—ฟ๐—ฒ๐—พ๐˜‚๐—ถ๐—ฟ๐—ฒ๐—บ๐—ฒ๐—ป๐˜๐˜€ for EMT-related services.

3. During this period, ๐—ฐ๐—ฒ๐—ฟ๐˜๐—ฎ๐—ถ๐—ป ๐—ฃ๐—ฆ๐——๐Ÿฎ ๐—ฟ๐—ฒ๐—พ๐˜‚๐—ถ๐—ฟ๐—ฒ๐—บ๐—ฒ๐—ป๐˜๐˜€ ๐—ฎ๐—ฟ๐—ฒ ๐—ฑ๐—ฒ๐—ฝ๐—ฟ๐—ถ๐—ผ๐—ฟ๐—ถ๐˜๐—ถ๐˜€๐—ฒ๐—ฑ (i. e. National Competent Authorities are advised not to actively enforce them) while CASPs transition toward compliance (e.g. safeguarding rules, IBAN use, open banking obligations), while others, such as strong customer authentication or fraud monitoring, shall remain applicable.

4. ๐—˜๐˜…๐—ฐ๐—ต๐—ฎ๐—ป๐—ด๐—ฒ ๐—ผ๐—ณ ๐—ฐ๐—ฟ๐˜†๐—ฝ๐˜๐—ผ-๐—ฎ๐˜€๐˜€๐—ฒ๐˜๐˜€ ๐—ณ๐—ผ๐—ฟ ๐—ณ๐˜‚๐—ป๐—ฑ๐˜€ ๐—ผ๐—ฟ ๐—ณ๐—ผ๐—ฟ ๐—ผ๐˜๐—ต๐—ฒ๐—ฟ ๐—ฐ๐—ฟ๐˜†๐—ฝ๐˜๐—ผ-๐—ฎ๐˜€๐˜€๐—ฒ๐˜๐˜€ ๐—ฟ๐—ฒ๐—บ๐—ฎ๐—ถ๐—ป ๐—ผ๐˜‚๐˜๐˜€๐—ถ๐—ฑ๐—ฒ ๐—ฃ๐—ฆ๐——๐Ÿฎ ๐˜€๐—ฐ๐—ผ๐—ฝ๐—ฒ. 5. EBA calls for legislative alignment via PSD3/PSR or MiCA amendments to prevent double authorisation requirement in future.
