We provide our clients with comprehensive legal and tax advice in the preparation of contractual documentation related to the development, servicing and licensing of software. We also have extensive experience in setting up tax structures designed to optimize revenue from software development and licensing.

We also specialise in advising on the implementation of and compliance with regulatory requirements in the digital technology sector. We provide legal services in the areas of telecommunications law and media regulation, advising clients on negotiating and concluding contractual documentation or obtaining licences.

We also focus on data protection, including the implementation of privacy policies, compliance of the client’s business model with the General Data Protection Regulation (GDPR) and other regulatory frameworks.

What is our experience?

In the areas of IT law, TMT and data protection, we provided the following legal services:

• Comprehensive legal advisory services to PS:Digital, s.r.o., a major marketing company, on the development of the Headranking web application, including the preparation and negotiation of a customized software development agreement, SLA, preparation of the terms of use of the application, assessment of the use of an artificial intelligence tool in the application with regard to the security of the protection of candidates’ personal data and complex processing of the personal data protection documentation;
• For the Slovak subsidiary AIP Medical Slovakia, s.r.o. of the Hungarian parent company AIP Medical Holding Zártkörűen Működő Részvénytársaság, we prepared documentation for the launch of a web application through which patients can solve their dermatological problems remotely;
• Negotiation of a distribution agreement and SLA in connection with the exclusive distribution of a mobile application of an American company in the EU, developed by the Slovak company Touch4IT s.r.o.;
• Preparation of end user license agreement (EULA) for MATSUKO s.r.o., a Slovak innovative company, which is a market leader in the field of holographic communication;
• Preparation of a model framework contract for the Slovak IT company Kiuub s. r. o. for the provision of no-coding services, including the preparation of new terms and conditions and model terms and conditions for the processing of personal data of the contract for the creation of customized software and SLA;
• Setting up a new telemarketing model for WeNet SK, s. r. o. in connection with the changes introduced by Act No 452/2021 Coll. on electronic communications.

In 2019, we organized our first conference aimed at IT companies. In November 2022, we organized a unique two-day conference for IT digital and technology companies, where we addressed selected legal and tax topics related to the IT, digital and tech segments in a practical way, including tax-tax optimization, “employing freelancers”, bringing an investor into the company, setting up a holding company, automated accounting, ESOP structures or scaling a business abroad.
